Privacy Policy

This Privacy Policy explains how Pivotal Retention LLC dba Aballel ("Aballel," "we," "us," or "our") collects, uses, discloses, retains, and protects information for our websites, software, hosted pages, campaign tools, AI-assisted workflows, analytics, support, and related services.

Privacy choices. You can request access, correction, deletion, portability, opt-out assistance, or other legally available privacy rights by emailing zack@aballel.com. We honor legally required privacy choices after verifying the request.

1. Scope

This Policy applies to Aballel-controlled websites, accounts, software, campaign workspaces, hosted tools, analytics, support, billing, marketing, and related services. It also explains how Aballel processes information about End Users when our customers use Aballel to collect, host, analyze, or process prospect, lead, visitor, subscriber, or customer data.

This Policy does not replace a customer's own privacy policy. Customers using Aballel-hosted pages, lead magnets, forms, emails, pixels, or integrations are responsible for providing their own legally sufficient notices, obtaining required consents, honoring rights requests, and complying with applicable privacy, advertising, email, SMS, and platform rules.

2. Our roles

For account registration, billing, Aballel-owned websites, Aballel marketing, product analytics, support, security, fraud prevention, and business operations, Aballel generally acts as an independent controller or business.

For Customer Personal Data that a customer submits to Aballel or collects through customer-controlled Hosted Assets, Aballel generally acts as a processor, service provider, or contractor for the customer, subject to our Terms, Data Processing Addendum, and the customer's instructions.

A customer is the controller, business, sender, advertiser, and party responsible for its Customer Personal Data, Hosted Assets, campaigns, offers, notices, consents, and End-User relationships.

3. Information we collect

We may collect the following categories of information:

Account and contact information: name, email address, phone number, organization name, role, login credentials, account settings, subscription status, and communications preferences.

Billing and transaction information: plan, invoices, payment status, tax information, billing address, purchase history, charge metadata, and payment processor records. Aballel does not intentionally store full payment card numbers when using third-party payment processors.

Business and brand information: business description, industry, website URLs, offers, product and service information, brand assets, logos, tone, audience details, campaign objectives, and compliance information you provide.

Customer Content and Customer Data: prompts, instructions, uploaded files, landing pages, forms, emails, lead magnets, campaign assets, generated Outputs, visitor events, form submissions, lead/prospect/customer records, segmentation, analytics, integration data, and other content or data submitted to, collected through, or processed in Aballel.

Usage, device, and technical information: IP address, device identifiers, browser type, operating system, referring URLs, pages viewed, actions taken, timestamps, authentication logs, error logs, product events, diagnostics, and security logs.

Cookies, pixels, and analytics data: cookies, local storage, tags, pixels, SDKs, session identifiers, attribution events, conversion events, and similar technologies described in our Cookie Policy.

Support and communications: emails, chats, calls, support tickets, feedback, survey responses, troubleshooting information, and recordings or transcripts where disclosed.

Information from third-party services: data from integrations you connect or enable, such as CRMs, ad platforms, analytics tools, email tools, payment processors, domain or DNS providers, customer websites, identity tools, and AI or infrastructure vendors.

Do not submit sensitive personal information, protected health information, payment card data, financial account numbers, government identifiers, biometric data, precise geolocation, children's data, or other regulated or restricted data unless Aballel has expressly authorized that use case in writing and you have all required rights, notices, consents, and safeguards.

4. How we use information

We use information to:

  • provide, host, operate, secure, maintain, debug, and support Aballel;
  • create accounts, authenticate users, manage subscriptions, process payments, and send service communications;
  • generate, personalize, test, optimize, and deliver AI-assisted Outputs, campaign assets, workflows, analytics, and recommendations;
  • operate hosted pages, lead magnets, forms, email flows, tracking, integrations, and customer workspaces;
  • analyze usage, measure performance, improve workflows, develop features, train internal quality processes, and maintain product reliability;
  • detect, prevent, and investigate fraud, spam, abuse, security incidents, platform evasion, policy violations, and unlawful activity;
  • respond to support requests, troubleshoot issues, and communicate about accounts, plans, updates, and offers;
  • enforce terms, collect amounts owed, manage disputes, comply with law, and protect Aballel, users, End Users, vendors, and third parties;
  • conduct business planning, reporting, analytics, corporate transactions, and recordkeeping; and
  • create aggregated, anonymized, or deidentified information that does not identify a person or customer.

5. AI processing

Aballel may process inputs, Outputs, Customer Content, campaign data, analytics, and business information through AI model providers and related vendors to generate, summarize, optimize, classify, score, test, and analyze content, workflows, audiences, and campaigns.

AI providers and automated systems may process Customer Data on our behalf under applicable vendor terms and privacy commitments. Where reasonably available and under Aballel's control, we configure AI providers not to use Customer Data to train their general-purpose models unless you enable that use, request it, or agree to it in writing. We may use aggregated, anonymized, or deidentified data to improve Aballel.

You remain responsible for reviewing AI Outputs before using them and for avoiding submission of sensitive or restricted data.

6. How we disclose information

We may disclose information to the following categories of recipients:

Service providers and subprocessors: hosting, storage, infrastructure, security, AI, analytics, diagnostics, payment processing, email delivery, messaging, support, CRM, automation, domain/DNS, and professional service providers.

Connected integrations: ad platforms, analytics tools, CRMs, email tools, SMS tools, customer websites, data sources, and other services that you connect, enable, or instruct us to use.

Payment processors: processors such as Stripe to process payments, prevent fraud, manage subscriptions, and maintain billing records.

Professional advisors: lawyers, accountants, auditors, insurers, banks, and consultants.

Authorities and rights holders: courts, regulators, law enforcement, government authorities, copyright complainants, platform operators, or other parties when required by law, legal process, or when we believe disclosure is necessary to protect rights, safety, security, or operations.

Business transaction parties: potential or actual buyers, investors, lenders, financing sources, successors, or advisors in connection with a merger, acquisition, financing, reorganization, bankruptcy, diligence process, or sale of assets.

At your direction: when you publish Hosted Assets, send communications, export data, invite users, connect integrations, or otherwise instruct us to share information.

Current vendor categories may include AI model providers such as OpenAI; cloud hosting, storage, security, and infrastructure providers such as Render, MongoDB Atlas, Amazon Web Services, and Sentry; payment processors such as Stripe; email and messaging providers such as SendGrid and Twilio; analytics and product measurement providers; ad platform integrations such as Meta, Google, TikTok, LinkedIn, and similar networks when you connect or enable them; and customer support, CRM, automation, domain, DNS, and professional service providers used to operate Aballel. Vendor names may change over time.

7. Sale, sharing, targeted advertising, and customer-controlled data

Aballel does not sell personal information for money. Aballel does not sell Customer End-User Data, use Customer End-User Data to independently market to those End Users, or provide Customer End-User Data to data brokers.

Some privacy laws define "sale," "sharing," or "targeted advertising" broadly. For Aballel-controlled websites, we provide legally required choices for applicable advertising or analytics technologies. We do not share personal information for cross-context behavioral advertising through Aballel-owned marketing pixels unless legally permitted and subject to required choices.

Customer-controlled integrations may send Customer Data to the customer's selected ad platforms, analytics tools, CRMs, email tools, SMS tools, or other services at the customer's direction. Customers are responsible for determining whether those transfers are lawful and for providing required notices, consent, and opt-out rights.

8. Cookies, pixels, and analytics

We use cookies, local storage, pixels, tags, SDKs, and similar technologies for authentication, security, preferences, analytics, product measurement, attribution, marketing performance, debugging, and service improvement. See our Cookie Policy for details.

Where required, non-essential analytics, marketing pixels, or similar technologies are gated by consent or another legally valid basis. Where legally required and technically feasible, Aballel honors recognized browser opt-out preference signals such as Global Privacy Control for Aballel-controlled websites. Customer-controlled Hosted Assets may require separate customer configuration and customer responsibility.

9. Customer Data and End-User requests

When customers use Aballel to collect, host, analyze, or process information about their prospects, leads, customers, subscribers, visitors, or audiences, the customer is responsible for providing legally sufficient notices, obtaining required consents, honoring privacy rights, and ensuring lawful use of Aballel.

If you are an End User of an Aballel customer, please contact that customer directly to exercise rights relating to your data or campaign interactions. If you contact Aballel about Customer Data, we may redirect your request to the customer, ask for information to identify the customer, or assist the customer according to our contractual obligations and applicable law.

10. Retention

We retain information for as long as reasonably necessary for the purposes described in this Policy, including account operation, legal compliance, dispute resolution, security, backup, audit, tax, billing, and business records.

Typical retention periods are:

  • account and billing records: up to 7 years after the account closes;
  • subscription, invoice, tax, and payment metadata: up to 7 years;
  • campaign inputs, generated Outputs, hosted pages, analytics, leads, and workspace records: while the account is active and for up to 24 months after closure unless a longer period is needed for backup, audit, legal, security, or dispute purposes;
  • product logs, security logs, and diagnostic events: up to 24 months;
  • support messages: up to 3 years;
  • marketing contact records: until you unsubscribe or the contact becomes inactive, plus suppression records as needed to honor opt-outs; and
  • backup copies: up to 90 days after deletion from active systems, unless legal, security, or technical reasons require longer retention.

We may retain aggregated, anonymized, or deidentified information without time limit where it no longer identifies a person.

11. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information. However, no website, software platform, transmission, storage system, vendor, or security measure can be guaranteed to be perfectly secure.

You are responsible for securing your account credentials, devices, users, integrations, customer websites, DNS settings, content, exports, and downstream systems.

12. Your privacy rights

Depending on your location and relationship to Aballel, you may have rights to access, know, correct, delete, port, restrict, or object to certain processing; to opt out of certain sale, sharing, targeted advertising, or profiling activities; to limit the use or disclosure of sensitive personal information; to withdraw consent where processing is based on consent; and to appeal certain privacy-rights decisions.

To exercise rights, email zack@aballel.com with your name, account email, request type, and enough information for us to verify your relationship to the account or data. Authorized agents may submit requests if they provide proof of authority and we can verify the underlying person where required.

You can opt out of Aballel marketing emails using the unsubscribe link in those emails. You can adjust browser cookie settings, use recognized browser opt-out signals where supported, disconnect optional integrations, disable non-essential technologies where controls are available, or ask us for help.

We may deny or limit requests where permitted by law, including when retaining information is necessary for security, legal compliance, transaction records, dispute resolution, account administration, free-speech interests, fraud prevention, or another permitted purpose.

13. Notice for California, Colorado, and other U.S. state privacy laws

Where applicable state privacy laws apply to Aballel as a business or controller, this Policy provides notice of the categories of personal information we collect, the purposes for collection and use, the categories of recipients to whom we disclose information, retention practices, and available privacy rights.

Categories of personal information we may collect include identifiers; commercial information; internet or electronic network activity; geolocation at a general IP-derived level; professional or employment-related information; audio or electronic communications with support; inferences; sensitive personal information only where necessary for account security or as provided by you; and Customer Personal Data processed on behalf of customers.

We collect and use these categories for the purposes described in Sections 4 through 10 of this Policy. We disclose these categories to the recipients described in Section 6. We do not knowingly sell or share personal information of consumers under 16. We do not use sensitive personal information for purposes requiring a right to limit unless we provide the legally required right or an exception applies.

Where required, you may opt out of sale, sharing, targeted advertising, or certain profiling by emailing zack@aballel.com, using available consent controls, or using a recognized browser opt-out preference signal such as Global Privacy Control on Aballel-controlled websites.

14. International processing

Aballel is based in the United States. Information may be processed in the United States and other countries where Aballel, its vendors, or integrations operate. These countries may have data-protection laws different from those in your location. Where required, we use appropriate contractual or legal mechanisms for international transfers.

15. Children

Aballel is not directed to children under 13 and is not intended for use by children. Customers may not use Aballel to knowingly collect personal information from children or to operate child-directed campaigns unless Aballel has expressly authorized the use case in writing and all required parental notices, consents, and safeguards are in place.

16. Changes to this Policy

We may update this Policy from time to time. Updated versions will be posted with an updated effective date. Material changes will apply prospectively unless required by law or necessary for security, legal, operational, or abuse-prevention reasons.
